Welcome to BenG. These Terms of Service (“Terms”) govern your use of the BenG mobile application and related services (the “Service”) operated by BenG Books LLC (“we,” “us,” or “our”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

BenG is a mobile application designed to help service-based businesses manage their operations, including:

  • Appointment scheduling and calendar management
  • Client management and communication
  • SMS appointment reminders and notifications
  • Payment processing
  • Document storage and compliance tracking

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3. SMS Messaging Terms

By using BenG's SMS features, you acknowledge and agree to the following:

For Service Providers (Users)

  • You are responsible for ensuring you have proper consent from your clients before adding their phone numbers to BenG.
  • BenG will send an opt-in SMS to new clients; no messages will be sent until the client replies “YES” to consent.
  • You will not use the SMS feature for marketing or promotional purposes.
  • You will comply with all applicable laws regarding SMS communications, including the Telephone Consumer Protection Act (TCPA).

For Clients (Recipients)

  • By replying “YES” to the opt-in message, you consent to receive appointment-related text messages from the service provider via BenG.
  • Message frequency varies based on your appointments (typically 3-5 messages per appointment).
  • Message and data rates may apply.
  • Reply STOP at any time to unsubscribe from messages.
  • Reply HELP for assistance.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send spam, unsolicited messages, or marketing communications through our SMS features
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to transmit harmful code or malware

5. Fees and Payment

Certain features of the Service may require payment. By subscribing to paid features, you agree to:

  • Pay all applicable fees as described in the app
  • Provide accurate billing information
  • Authorize us to charge your payment method

All fees are non-refundable unless otherwise stated or required by law.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by BenG Books LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. User Content

You retain ownership of any content you submit through the Service. By submitting content, you grant us a license to use, store, and process that content as necessary to provide the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENG BOOKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless BenG Books LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for any reason. You may also delete your account at any time. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and changing the “Last updated” date. Continued use of the Service constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.
